Koh Phangan's other zoning layer: the Town Planning Act comprehensive plan behind the 2025 eco-zone rules

The May 2025 environmental-protection notification isn't the only zoning instrument on Koh Phangan. A separate Town Planning Act "comprehensive plan" — last set by a 2015 Ministerial Regulation — layers its own land-use classification underneath it, and Thailand's own architects' association documents places nationwide, Koh Phangan included, where an older plan has had to run on a temporary ordinance pending a replacement.

The 2025 environmental-protection rules tell you about elevation and coastal-distance limits — but they're not the only zoning law governing a Koh Phangan plot. A separate, older instrument under the Town Planning Act (the "ผังเมืองรวม," or comprehensive plan) sets the underlying land-use classification — whether a parcel is even zoned residential, agricultural or conservation in the first place — and it sits on top of, not instead of, the 2025 eco-zoning.

What a comprehensive plan is, and Koh Phangan's own

Koh Phangan's current-generation comprehensive plan was set by a Ministerial Regulation dated B.E. 2558 (2015), gazetted 24 August 2015, covering Koh Phangan and Ban Tai subdistricts. It's administered locally by Phet Phangan Municipality together with the Surat Thani Provincial Town Planning Committee, and it's a live instrument, not a historical curiosity: the municipality petitioned to amend it as recently as 2023 (to permit a new Koh Phangan hospital building), with the provincial committee giving its approval on 2 March 2023.

Why comprehensive plans expire — and why that matters

  • Under the old Town Planning Act (B.E. 2518), a comprehensive plan was valid for a fixed 5-year period and had to be formally renewed or replaced by a new Ministerial Regulation once that period lapsed.
  • The 2019 Town Planning Act (B.E. 2562) changed this going forward: a plan no longer expires on a fixed clock — instead, an evaluation report is required at least every 5 years, and the plan stays in force unless conditions justify a formal revision.
  • That 2019 change doesn't retroactively cure a plan that had already lapsed under the old rule. The Association of Siamese Architects — Thailand's professional architecture body — maintains a public list of dozens of localities nationwide where an old comprehensive plan expired before a replacement was gazetted, forcing a temporary local ordinance restricting construction to bridge the gap. Koh Phangan appears on that list, with an entry dated B.E. 2551 (2008), predating the current 2015 plan.

What this means for a buyer or builder

Two separate regulators and two separate documents govern what you can build: the 2025 environmental-protection notification (elevation and coastal-distance limits) and the Town Planning Act comprehensive plan (the underlying land-use classification and floor-area/open-space rules for that classification). A plot has to clear both. Because comprehensive plans nationwide do lapse and sometimes run for years on an interim ordinance before a replacement is gazetted, don't assume a zoning summary from a seller or agent reflects the version currently in force. As part of the due-diligence checklist — alongside the hillside and coastal setback checks already covered — confirm directly with the Surat Thani Provincial Town Planning Office or Phet Phangan Municipality which comprehensive plan or interim ordinance currently governs the specific tambon your plot sits in.
